Welcome to RejuvenatePath.com.au. These Terms of Service ("Terms") govern your access to and use of our spa directory platform and business listing services. These Terms constitute a legally binding agreement between you and RejuvenatePath.

Please read these Terms carefully. By accessing or using our Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

1. Acceptance of Terms

1.1 Agreement to Terms

By accessing or using RejuvenatePath.com.au (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

1.2 Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes via email or through a prominent notice on our website. Your continued use of the Service after changes constitutes acceptance of the modified Terms.

1.3 Eligibility

You must be at least 18 years old to use this Service. By using the Service, you represent that you meet this age requirement and have the legal capacity to enter into these Terms.

2. User Accounts and Responsibilities

2.1 Account Registration

To list a business or access certain features, you must create an account. You agree to:

  • Provide accurate, current, and complete information
  • Maintain the security of your password and account
  • Notify us immediately of any unauthorized access
  • Accept responsibility for all activities under your account

2.2 Prohibited Conduct

You agree not to:

  • Violate any laws or regulations
  • Infringe on intellectual property rights
  • Submit false, misleading, or fraudulent information
  • Engage in spam, harassment, or abusive behavior
  • Attempt to hack, disrupt, or compromise the Service
  • Scrape or data mine the Service without permission
  • Impersonate another person or entity

3. Business Listings and Subscriptions

3.1 Listing Requirements

Business listings must:

  • Represent a legitimate, operating spa or wellness business in Australia
  • Contain accurate contact information and business details
  • Comply with all applicable Australian consumer protection laws
  • Not contain offensive, discriminatory, or illegal content

3.2 Subscription Tiers

We offer Free, Premium ($79/month), and Featured ($249/month) listing tiers. Subscription fees are billed monthly or annually as selected. All fees are in Australian dollars (AUD) and exclude GST.

3.3 Payment Terms

Payments are processed securely through Stripe. You authorize us to charge your payment method on the billing date. Failed payments may result in service suspension.

3.4 Cancellation and Refunds

You may cancel your subscription at any time. Your listing will remain active until the end of the current billing period. We offer a 14-day money-back guarantee for new subscriptions. After 14 days, no refunds will be provided for partial months.

3.5 Listing Removal

We reserve the right to remove or suspend any listing that violates these Terms, is reported as fraudulent, or is deemed inappropriate. Repeated violations may result in account termination without refund.

4. Intellectual Property

4.1 Service Content

All content on RejuvenatePath, including text, graphics, logos, software, and design elements, is owned by or licensed to RejuvenatePath and protected by Australian and international copyright laws.

4.2 User-Submitted Content

By submitting content (photos, descriptions, reviews) to the Service, you:

  • Grant us a worldwide, non-exclusive, royalty-free license to use, display, and distribute your content
  • Represent that you own or have permission to use the content
  • Agree we may use your business name and branding in promotional materials
  • Retain ownership of your original content

4.3 Copyright Complaints

If you believe content on our Service infringes your copyright, contact us at legal@rejuvenatepath.com.au with details of the alleged infringement.

5. Disclaimers and Limitations of Liability

5.1 Service "As Is"

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

5.2 Third-Party Content

RejuvenatePath is a directory platform. We do not endorse, guarantee, or assume responsibility for the quality, safety, or legality of listed businesses or services. Users interact with businesses at their own risk.

5.3 Limitation of Liability

To the maximum extent permitted by Australian law, RejuvenatePath and its officers, directors, employees, and agents shall not be liable for:

  • Any indirect, incidental, special, or consequential damages
  • Loss of profits, revenue, data, or business opportunities
  • Damages arising from third-party businesses or services
  • Service interruptions, errors, or security breaches

5.4 Maximum Liability

Our total liability to you for any claims arising from these Terms or the Service shall not exceed the amount you paid us in the 12 months preceding the claim, or $100 AUD, whichever is greater.

5.5 Consumer Guarantees

Nothing in these Terms excludes, restricts, or modifies any consumer rights or guarantees provided under the Australian Consumer Law that cannot be excluded by contract.

6. Dispute Resolution and Governing Law

6.1 Governing Law

These Terms are governed by the laws of New South Wales, Australia. You agree to submit to the exclusive jurisdiction of the courts of New South Wales for any disputes.

6.2 Dispute Resolution Process

Before initiating legal action, you agree to:

  • Contact us at legal@rejuvenatepath.com.au to attempt informal resolution
  • Provide a detailed description of the dispute and desired resolution
  • Engage in good faith negotiations for at least 30 days

6.3 Mediation

If informal resolution fails, the parties agree to attempt mediation before pursuing litigation. Each party will bear its own costs of mediation.

6.4 Class Action Waiver

To the extent permitted by law, you agree to resolve disputes with us on an individual basis and waive the right to participate in class actions or representative proceedings.

7. Termination

We reserve the right to suspend or terminate your account and access to the Service at our discretion, without notice, for:

  • Violation of these Terms
  • Fraudulent or illegal activity
  • Conduct that harms other users or the Service
  • Non-payment of subscription fees

Upon termination, your right to use the Service ceases immediately. We may delete your content and account data, though some information may be retained as required by law or for legitimate business purposes.

8. Privacy and Data Protection

Your use of the Service is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal information in accordance with the Australian Privacy Act 1988 (Cth).

By using the Service, you consent to the collection and use of your information as described in our Privacy Policy.

9. Indemnification

You agree to indemnify, defend, and hold harmless RejuvenatePath and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including legal fees) arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any rights of another party
  • Content you submit to the Service
  • Your business operations or services

10. Miscellaneous

10.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and RejuvenatePath regarding the Service.

10.2 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

10.3 Waiver

Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.

10.4 Assignment

You may not assign or transfer these Terms without our written consent. We may assign our rights and obligations without restriction.

10.5 Force Majeure

We are not liable for any delay or failure to perform due to circumstances beyond our reasonable control, including natural disasters, war, terrorism, labor disputes, or internet service failures.
